Sept. 19, 2017—Waymo on Saturday asked a California federal judge to delay the trial date for its trade secret misappropriation suit against Uber, saying it needs to scale ample evidence revealed by a report that came out following a recent Federal Court ruling. This story was first reported by law360.com.

The request occurred shortly after the Federal Circuit affirmed U.S. District Judge William Alsup’s ruling that Alphabet Inc.’s self-driving car unit, Waymo LLC, could have a due diligence report prepared that studied concerns regarding Uber acquiring a self-driving car company that was started by former Waymo employee Anthony Levandowski. Levandowski allegedly downloaded 14,000 confidential files before quitting the company, law360.com reported.

Now that Waymo has the report, it says it would be “unfairly prejudiced” in having just a few weeks to go through lots of evidence before trial. Uber responded Monday, saying either a jury trial or a limited bench trial should be held in October.

Judge Alsup is expected to address both parties during a hearing on Wednesday.
