McElwain Brothers Paint and Collision in Pennsylvania has paid $67,462 in back wages and damages to 12 workers to settle a federal Department of Labor complaint.
September 24, 2018—A prominent auto paint and collision shop in Ellwood City, Pa., has paid $67,462 in back pay and damages to some of its workers, according to the Ellwood City Ledger.
The U.S. Department of Labor released a statement Thursday saying it conducted an investigation into Boehm Family Enterprises LLC, doing business as McElwain Brothers Paint and Collision in Ellwood City, and determined it had violated the Fair Labor Standards Act when it came to overtime work by 12 mechanics and painters, according to the report.
According to the Ellwood City Ledger, the department found that the shop incorrectly classified the workers as exempt from the law’s overtime requirements and only paid them straight time when they worked more than 40 hours in a work week. Also, the company failed to include employee performance bonuses when determining overtime pay, the department said.
According to the statement, the company has paid $33,731 in back wages and an equal amount in damages to the affected workers as a settlement of the matter.
