Ohio Body Shop Fails to Follow OEM Procedures, Loses Appeal of Attorney Fees

An Ohio appellate court on Friday rejected an auto body shop's arguments in a $105,462 case where the body shop was convicted for failing to follow OEM procedures during a repair.

July 17, 2018—An Ohio appellate court on Friday rejected an auto body shop's arguments in a $105,462 case where the body shop was convicted for failing to follow OEM procedures during a repair.

The Ohio appellate court rejected the auto body shop's arguments related to attorney fees, diminished value and a new trial decision.

Williams vs. Sharon Woods Collision Center involved a 2010 Nissan Maxima that plaintiff Jeremy Williams brought to the shop for repairs.

The jury found in favor of the consumer in regards to an improperly repaired Nissan sedan. According to the court document, evidence at trial showed that in repairing the car, Sharon Woods Collision Center had used structural bonding adhesive to attach panels to the car, a method which was not approved by the manufacturer or appropriate under I-CAR guidelines.
