A former Caliber Collision technician has filed a lawsuit against the MSO, alleging he was not paid for all the hours he worked.
The lawsuit, filed in the California Superior Court, alleges that Caliber Bodyworks of Texas Inc., which operates Caliber Collision, paid Samuel Castillo per task performed — flat rate — rather than per hour worked. Tasks have designated completion times, and technicians are paid based on these standards, rather than by the actual labor time.
The suit alleges this method of payment, dividing daily flat rate earnings by daily hours worked, violates California labor law.
The flat rate versus hourly rate debate has been longstanding in the industry, especially for California repair shop operators.
